Acknowledgment of Risk and Release of Liability

(To be signed by participants of the age of majority and over; or

by the Parent or Guardian of those under the age or majority.)

Disclaimer

1. The York Curling Club and its directors, officers, committee members, members, employees, coaches, volunteers, officials, participants, agents, sponsors, owners/operators of the facility, and representatives (the “Organization”) are not responsible for any injury, property damage, expense, loss of income, damage or loss of any kind suffered by a Participant during, or as a result of, any program, activity or event of the Organization, caused in any manner whatsoever including, but not limited to, the negligence of the Organization.

Description of Risks

1. I am participating voluntarily in the sport of curling and the activities, events and programs of the Organization. The ice rink is slippery and should be used with caution. Curling rocks can proceed down the ice at a fast pace. Participants need to ensure they are aware of their surroundings at all times.  I understand that injuries sustained in curling can be severe and even fatal. In consideration of my participation in the sport of curling and the programs, activities and events of the Organization, I hereby acknowledge that I am aware of the risks, dangers and hazards associated with or related to the sport of curling and the programs, activities and events of the Organization. These risks include, without limitation, and among other things:

1. Falling because of slippery ice, or uneven or irregular ice surfaces;
2. Falling while delivering the curling stone, skipping or sweeping;
3. Physical contact with other participants, spectators, equipment and vehicles;
4. Running or sliding on the ice surface.
5. Travel to and from York Curling Club

Release of Liability

1. In consideration of the Organization allowing me to participate, I agree:
   1. That my physical condition has been verified by a medical doctor to participant in the sport of curling and in the activities, events and programs of the Organization;
   2. To waive any and all claims that I may have now or in the future against the Organization;
   3. To freely accept and fully assume all such risks and possibility of personal injury, death, property damage, expense and related loss, including loss of income, resulting from my participation in the activities, events and programs of the Organization;
   4. To assume all risks arising out of, associated with or related to my participation;
   5. To be solely responsible for any injury, loss or damage that I might sustain while participating; and,
   6. To forever release, discharge, save harmless and indemnify the Organization from any and all liability for any and all claims, demands, actions, damages (including direct, indirect, incidental, special and/or consequential), losses (economic and non-economic), judgments, executions and costs (including legal fees) which I may have or may in the future, that might arise out of my participation in the activities, events and programs of the Organization or my traveling to or from, due to any cause whatsoever, even though such risks, injuries, loss, damage, claims, demands, actions or costs may have been caused by any manner whatsoever, including but not limited, to the negligence, omissions, carelessness, breach of contract, or breach of any duty of care of the Organization.

Acknowledgement

As a participant in the programs, activities and events of the York Curling Club, the undersigned acknowledges and agrees to the above and has not been unduly influenced to signing this agreement.
